False Claims and Whistleblower Laws

VistaCare strives to achieve the highest business and personal ethical standards as well as comply with the laws and regulations that apply to the hospice industry and publicly traded companies. Our Code of Business Conduct and Ethics and our False Claims Policy provide guidance regarding our compliance efforts.

All VistaCare employees, officers, directors, contractors, consultants, agents, volunteers, representatives and suppliers are required to follow our Code of Business Conduct and Ethics. Our Compliance Program is designed to establish within VistaCare a culture that promotes the prevention, detection and resolution of conduct that does not conform to the requirements of federal and state law and VistaCare’s policies.

False Claims Policy

VistaCare’s False Claims Policy sets out our policies and procedures for detecting and preventing fraud, waste and abuse in connection with the Medicare and Medicaid programs. This policy includes detailed information about the federal False Claims Act, federal administrative remedies for false claims and statements, state laws pertaining to civil or criminal penalties for false claims and statements, and whistleblower protections under such laws.

Whistleblower Laws

Federal and state laws have been enacted regarding fraud, waste and abuse in connection with healthcare reimbursement programs such as Medicare and Medicaid. Some of these laws include “whistleblower” provisions designed to protect employees reporting illegal conduct to appropriate authorities, and they may also include provisions that allow the employee to receive a portion of a monetary recovery by the government. A summary of these laws is provided below. As outlined in VistaCare’s policies, suspected illegal conduct should be reported to VistaCare management, VistaCare’s Chief Compliance Officer or General Counsel, the VistaCare hotline (1-866-872-6498), VistaCare’s Board of Directors or to the appropriate federal or state agency.
